Terms of use
The agreement
These terms are an agreement between you and Adam Frazier, who runs ExpLife ("we", "us"). They cover the ExpLife apps for iOS and Android and the website explifeplus.com. By creating an account or using ExpLife, you agree to them. Our privacy policy explains what we do with your data.
Who can use ExpLife
- You must be 13 or older.
- If you're under 18, or under the age of majority where you live, a parent or guardian must agree to these terms for you.
- One account per person. Your account is for your own use, so don't share it, sell it or use someone else's.
- Give your real email address and your real year of birth.
Your account
Keep your password to yourself. You're responsible for what happens in your account. If you think someone else is using it, email devnua@gmail.com. You can delete your account at any time from the Account tab.
Using ExpLife fairly
Points, badges and rewards only mean something if they're earned honestly. Don't:
- fake your location, check in somewhere you aren't, or use tools that change your phone's location;
- post or pass on gate codes so people can check in without being at the event;
- make extra accounts, or use someone else's, to earn more rewards;
- use bots, scripts or other automated tools with ExpLife;
- try to get around our security, read data that isn't yours, or disrupt the service;
- copy, sell or reverse engineer the app, except where the law allows it;
- use ExpLife to break the law or to harm anyone.
What you log
What you enter in ExpLife, such as your activities, notes and gear, stays yours. You let us store and use it only to run ExpLife for you, as the privacy policy describes. Don't put anything in your notes that's illegal or that you don't have the right to share.
Points, levels and badges
Points, levels, streaks and badges are for fun. They have no cash value and can't be sold, swapped or turned into money. We may correct them if they're wrong, for example after a bug or a check-in that broke these terms.
Sponsor offers and rewards
The Rewards tab shows offers from sponsors, such as brands, teams and organizations. Each offer is labelled with the sponsor's name.
- The sponsor provides the reward. The sponsor named on the offer supplies the reward, sets its conditions and is responsible for honouring it. Any terms the sponsor sets are shown with the offer and apply as well as these.
- How to earn one. Do what the offer asks between its start and end dates. Our servers decide whether you've done it from your check-ins, not from anything the app says. Rewards go to everyone who qualifies until they run out. There are no prize draws, and you never have to buy anything to earn one.
- One per person. You can unlock each offer once. Some offers are only for people above a certain age, and we use your year of birth to decide which offers you see.
- Using your reward. Follow the instructions that come with it, and use it by its use-by date if it has one. Rewards have no cash value, and you can't sell or transfer them unless the sponsor's terms say you can. Rewards are void where the law prohibits them.
- If something goes wrong. If a code doesn't work, contact the sponsor first. If that doesn't help, email devnua@gmail.com and we'll take it up with them. We don't make or sell the sponsor's products and can't promise anything about them, so questions about a product or a purchase are between you and the sponsor.
- Cancelling rewards. We may cancel or withhold a reward earned by breaking these terms, for example with a faked check-in or a second account. We may also pause or end an offer early. A reward you earned fairly still works until its use-by date.
- Your privacy. Taking part doesn't give the sponsor your name, email address or location. When you use a reward at the sponsor's shop, website or venue, you deal with the sponsor directly, and their privacy policy covers what they collect.
Staying safe
Take care when you're active and at events. Follow venue rules and staff instructions, and don't use the app while driving. ExpLife doesn't give medical or fitness advice. If you're not sure a new kind of exercise is right for you, ask a doctor first.
Our app
We own ExpLife, including its name, design and code. While you follow these terms, you may use the app for your own personal, non-commercial use. That permission is personal to you and can't be passed on. We may change, add or remove features, and we may stop offering ExpLife. If we shut it down, we'll give at least 30 days' notice in the app where we can.
Ending your use
You can stop using ExpLife and delete your account at any time. We may suspend or close an account that breaks these terms, or when the law requires it. We'll tell you why, unless the law or the security of the service stops us.
Disclaimer
We work to keep ExpLife running and accurate, but it's provided "as is" and "as available". To the extent the law allows, we don't promise that it will always be available or free of errors, or that every check-in will succeed.
Limits on our liability
To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost profits or lost data, or for sponsors' products and rewards. Our total liability to you for all claims about ExpLife is limited to US$50. Nothing in these terms limits liability that the law doesn't allow us to limit.
Law and disputes
These terms are governed by the laws of the State of Nebraska, USA. If you have a problem with ExpLife, please email us first so we can try to sort it out. If we can't, the dispute will be decided by the state or federal courts in Nebraska, unless the law where you live lets you bring it in your local courts. If you live outside the United States, you keep the protections your local consumer law gives you.
App stores
If you got ExpLife from Apple's App Store or Google Play, these terms are between you and us, not Apple or Google, and we alone are responsible for the app. The store's own terms also apply to your use of the store. For the iOS app:
- Apple has no duty to provide maintenance or support for it.
- If it fails to meet a warranty that applies, you can tell Apple, and Apple will refund any price you paid (ExpLife is free). Apple has no other warranty duty for it.
- We, not Apple, are responsible for handling claims about the app, including product liability, legal or regulatory compliance, consumer protection and claims that it infringes someone's rights.
- You confirm you're not in a country under a US government embargo, and not on a US government list of prohibited or restricted parties.
- Apple and its subsidiaries can enforce these terms against you as third-party beneficiaries.
Changes to these terms
When we change these terms, we'll update the date at the top. If a change matters, the app will ask you to agree again before you carry on.
General
If part of these terms can't be enforced, the rest still applies. If we don't enforce a term straight away, we can still enforce it later. You can't transfer these terms to anyone else. We may transfer them to a buyer of ExpLife, who must keep to them.
